practices for collecting, storing, using, and disclosing the personal (and
other) information that we may obtain about you through any of the Sites.
Please note that by using or accessing any of our Sites or shopping at our

and disclosure practices described in this privacy policy.

use cookies, web beacons, and other online information-gathering tools in
connection with our Sites. These tools are intended to make using our
Sites easier by, among other things, saving your preferences for you. We
may also use cookies to deliver content tailored to your interests. If

that you are about to receive a cookie and you reject it, then your use of
our Site may not be as efficient as it would be if the cookie were
    enabled.

Cookies, Web Beacons, and Other Similar Technologies
:

Our Site uses “cookie” and “web beacon”
technology. We use cookies and web beacons to identify your device, provide
website user authentication, conduct fraud prevention and management services,
distinguish you from other visitors, record your IP address and understand your
use of our Site, and identify the name of the Web site from which you linked to
Captain Pools. This information is used for fulfilling contracts with our
business partners, and to help us serve you better by improving our website
design, as well as our products, services, and promotions. We do not otherwise
track any information about your use of other websites. Information obtained
through cookies and web beacons may be shared with or obtained by service
providers on our behalf.

A cookie is a small data file that is placed on the hard drive of your computer
when you visit a website. A “session cookie” expires immediately when
you end your session (i.e., close your browser). A “persistent
cookie” stores information on the hard drive so when you end your session
and return to the same website at a later date, the cookie information is still
available. A web beacon is a small string of code that represents a clear
graphic image and is used in conjunction with a cookie.

When you visit our Site, we may use both a session and a persistent cookie.
This Captain Pools-placed cookie may contain information (such as a unique user
ID) that is used to track your usage of our Site and in some cases, your email
address. A web beacon allows us to capture certain additional types of
information about a visitor’s actions on a web site, such as a visitor’s cookie
number, the time, date, duration and number of page views, a description of the
page where the Web beacon is placed, and details about any items that were
purchased.

The Captain Pools-placed cookie allows us to recognize you when you return to
our Site and provides you with access to your account information. If you save
your information with or order from us, we may also use cookies to monitor and
maintain information about your use of our Sites. If you have not saved your
information with or ordered from us, we may monitor and maintain information
about your use of our Sites in a manner that does not identify you. You can
disable cookies at any time by using your browser options; however, if you turn
off cookies, we will not be able to track your order or enable you to make a
purchase from our Sites. In addition, we will not be able to recognize you as a
registered user to allow you access to your account information.

We may use Flash Cookies (also known as Local Stored Objects) or other similar
technologies. A Flash cookie is a small data file placed on a computer using
Adobe Flash technology that may be built into your computer or downloaded by
you to your computer. We use these technologies to personalize and enhance your
online experience, facilitate processes, personalize and store your settings.
Flash cookies may help our website visitors to, for example, set volume
preference associated with a video experience, play games and perform surveys.
They help us improve our sites by measuring which areas are of greatest
interest to customers. We do not use Flash cookies for marketing or behavioral
targeting purposes. Flash cookies are different from browser cookies and the
cookie management tools provided by your browser will not remove Flash cookies.
Learn how to manage privacy and storage settings for Flash cookies. If you
disable Flash cookies or other similar technologies, please be aware that you
may not have access to certain features and services that make your online
experience more efficient and enjoyable.

Browser Do Not Track Signals
At this time, our Sites do not support “Do Not Track” preferences that
may be available in your browser for letting websites know that you do not want
them collecting certain kinds of information. Specifically, if you turn on the
Do Not Track setting on your browser, our Sites are not currently capable of
following whatever Do Not Track preferences you set. For more information about
Do Not Track, visit donottrack.us.

Children :

Our Sites are not designed to appeal to persons under 13 years
old (“children”). We do not knowingly collect or maintain personal
information from children through our Sites, except for persistent identifiers
that may be collected through children’s sections of our Sites which (as
permitted by applicable law) we will use solely to support the internal
operations of the Sites. If we learn that any unauthorized personal information
of a child has been collected, we will take appropriate steps to delete such
information. If you are a parent or guardian and discover that your child has
provided any such personal information to us, then you may contact us at the
email or mailing address noted at the end of this privacy policy below and
request that we delete that information from our systems.

Links to Other Websites and Services :

This privacy policy only addresses Captain Pools
practices for the personal (and other) information that we may obtain about you
through any of the Sites. Please be aware that when you use or access any of
the Sites, you may be directed to other websites that are beyond our control,
and Captain Pools is not responsible for the privacy practices of third parties
or the content of linked websites. We would expect most, if not all, of these
third parties will collect information about you when you use their offerings.
However, Captain Pools is not responsible for the privacy practices of third
parties, regardless whether they are linked or otherwise connected to our
Sites. We encourage you to read the posted privacy policy and terms of use
whenever interacting with any third-party website, app, or other offering.

California Privacy Rights :

California law entitles residents to ask us for a notice
describing what categories of personal information we share with third parties
or with corporate affiliates for those entities direct marketing purposes. Captain
Pools does not provide any personal information to third parties for their own
direct marketing purposes. If you want to request a notice or have any
questions about Captain Pools privacy practices,
please contact us at [email protected].

Video Recording :

We conduct video surveillance at our stores for security, fraud
and loss prevention purposes and for incident reporting purposes. We use the
images and information from such videos only as required for such purposes and
for certain operational purposes, such as to measure traffic patterns in our
stores.

Governing Law :

By choosing to visit any of our Sites, you agree that any
dispute over privacy or the terms contained in this privacy policy will be
governed by the law of the State of Arizona, without reference to the choice of
law or conflicts of law principles thereof, and will be subject to the dispute
resolution clause contained in the terms of use applicable to the particular
Site. You also agree to abide by any limitation on damages contained in the
terms of use applicable to the Site or any other agreement that we have with
you.

Business Transitions :

As we continue to develop our business, we may undergo a
business transition such as acquiring another company, merging with an existing
company, or selling a portion of our assets. In such transitions, customer
information is typically one of the business assets that is transferred or
acquired by a third party. In the unlikely event that Captain Pools or
substantially all of its assets are acquired or enter a court proceeding, you
acknowledge that such transfers may occur and that your personal information
can continue to be used as set forth in this Privacy Policy.

Privacy Policy Updates :

We reserve the right to make changes to this privacy policy at
any time, with any such changes to be effective prospectively. Your continued
use of our Sites, or your continued business with us at our retail stores, will
indicate your acknowledgment of the changes and agreement to be bound by the
terms and conditions of the Privacy Policy, as revised.
